Eminem Gets OK To Bite Apple

A Detroit federal judge has ruled that Eminem’s copyright infringement lawsuit against Apple Computer for their unauthorized use of “Lose Yourself” can proceed:

District Judge Anna Diggs Taylor ruled that Em’s suit against MTV parent company Viacom and advertising agency TBWA/Chiat/Day can go forward. However, Taylor dismissed two state claims of unfair competition and unjust enrichment.
Though they failed to secure Eminem’s permission to use “Lose Yourself” for the campaign, the computer company began running ads on their web site and television in July 2003. The ad, which aired on MTV, featured a 10-year-old rhyming Slim’s song in a promotional spot for Apple’s and iPod’s music player iTunes.
In related Eminem news, Slim will be hosting the Hip-Hop Summit at Detroit’s Fox Theater this weekend. 50 Cent, Obie Trice, Reverend Run and Doug E. Fresh will also make appearances.
